(An Australian private company ABN 88 087 371 248 referred to as “Webjobz Group”, “We “, “Us” or WEBJOBZ, ), and includes a job posting service page on which Members of Webjobz Group, and non-members may post employment opportunities (“positions”) or Company Profiles. In maintaining this website WEBJOBZ, is not acting as an employment agency, and will neither attempt to match applicants with job openings nor assure that any job seekers will respond to a posting. All postings must comply with these Terms and Conditions. In these Terms and Conditions a party posting or intending to post positions on the website is referred to as “Employer” or “You”. No refunds will be given for job postings submitted on Webjobz Group. Please consider this before you post your job.
An Employer Account membership entitles a subscribing branch or office of a company (“Member” or “Employer” or “Customer”) to use of a Webjobz Group Employer Account (“Account”) for the duration of their paid membership period. The use of the Account is subject to the terms of this Agreement. Membership entitles a Member a Company Profile for the duration of the paid membership period. A Company Profile is a description of a hiring company, employer or recruiter placed on an Webjobz Group site for a period less than or equal to the length of their Membership. An employer may create their Company Profile from within their Webjobz Group Account. A Customer may edit, free of charge, their Company Profile using their Account There is no limit to the number of edits. A Company Profile created through other methods may incur a separate programming or editing charge, which will be arranged in advance with the Customer. Memberships are on a per office or per branch basis. Companies wishing to post jobs for multiple branches/office must purchase individual memberships. Please contact our sales office to enquire about available discounts if you have three or more branches/office.
a) UNLIMITED POSTING MEMBERSHIP
Unlimited Membership entitles Employers to post jobs onto the Webjobz Group Web Site from their Account. Employers may add an unlimited number of jobs if they have purchased an Unlimited Posting membership for the duration of their membership period. Each posting will be e-mailed in full to all Job Seekers in the Job Alert database on the day they are listed. Unlimited posting membership is restricted to an individual Company Profile. In principle, individual memberships need to be purchased for each Company Profile. Bulk discounts maybe available if multiple memberships over multiple Company Profiles are required.
b) LIMITED POSTING
Employers that purchase individual job postings will have the ability to post as many jobs as they have purchased. Each posting will be e-mailed in full to all Job Seekers in the Job Alert database on the day they are listed. Unused job posting credits do not expire and are non-refundable.
c) ACCESS TO CV DATABASE
Employers have the option of purchasing access to the CV database for a limited period. During this period, employers may contact as many Job Seekers as they wish providing they comply with the these terms and conditions.
CONFIRMATION, BILLING AND PAYMENT – EMPLOYER ACCOUNT.
Employers must pay in advance by direct bank transfer or must provide WEBJOBZ, a valid company Purchase Order number (“PO”). All POs must be approved by Webjobz Group before their account will be activated. WEBJOBZ, may contact Employers wishing to pay using a PO as part of the approval process. Webjobz Group will send an e-mail confirmation to the employer upon creation of a Membership Account.
ONE POSITION PER JOB POSTING.
Each posting shall advertise only one position. Multiple job openings will require multiple postings. Discounts, if any, for multiple postings are as set forth in the fee schedule.
NO DUPLICATE JOB POSTING
Each job can only be posted once. Duplications will be deleted by WEBJOBZ. Repeated offences maybe penalised with suspension of the companies account, without compensation.
All charges for services provided by Webjobz Group are due at the time services are rendered unless special arrangements have been made between you and an WEBJOBZ, Account Representative.
ALL TRANSACTIONS ARE IN AUSTRALIAN DOLLARS
DELIVERY OF GOODS and SERVICES
All purchases on our websites are for services only. There is no delivery of goods.
WEBJOBZ, may deactivate and then terminate an Account if a Customer is found to be defrauding WEBJOBZ by any of the following actions:
- Creating multiple Company Profiles to gain multiple free postings
- Creating multiple Company Profiles to obtain multiple bogus free-trail memberships.
- Employers are found to be charging Job Seekers to use their services.
- Using CV database for means other than offering legitimate employment opportunities.
- Using CV database to send SPAM or non-employment related material.
- Using CV database to sell the services of their own or a third party company and/or product.
- Using bots, agents or programs to download the CV database.
ACCOUNT DEACTIVATION AND TERMINATION.
WEBJOBZ, may deactivate and then terminate an Account if a Customer has breached these Business Terms or the Terms of Service or if the customer has failed to pay the Membership fee. No refunds will be given.
WEBJOBZ, provides on-line assistance via its Help feature and Frequently Asked questions (both available on the Webjobz web site). Customer Service and Tech Support Representatives are also available e-mail at email@example.com
Customers retain full ownership of their creative work and account data including company information and policies, job postings, and resumes. Customers are solely responsible for the accuracy of this information, and WEBJOBZ, will refer any inquiries regarding such information to the Customer.
WEBJOBZ, displays information about relevant job opportunities and may choose not to accept postings that are not appropriate for the nature of its audience. If a posting appears on the website and is subsequently removed by WEBJOBZ, for violation of these Terms and Conditions or otherwise, WEBJOBZ, in its discretion will determine whether to refund or credit all or part of the fee to the Employer. Repeated submission of inappropriate postings will subject the Employer to cancellation of Employer’s Membership and a loss of posting privileges.
REPRESENTATIONS BY EMPLOYER.
By submitting a posting to the website, the Job Poster or Employer represents (a) that the posting accurately describes the position being advertised, the nature of the company for which the position is being advertised, and the level of compensation being offered, (b) that the Job Poster or Employer actually intends to hire a person to fill the position being advertised, (c) that it is a position within the Poster’s own company or that the Poster is a recognised agent or recruiter for another company and (d) that the Employer will consider on an equal basis all applicants who respond to the posting, without regard to race, colour, religion, sex, national origin, age, handicap or disability, marital status, veteran’s status, citizenship status, sexual preference, or any other protected group status.
NO IMPROPER USE OF WEBSITE.
Employer shall not upload, post or transmit to or distribute or otherwise publish through the website, any material which (i) restricts or inhibits any other user from using or enjoying the website, (ii) in WEBJOBZ, ‘s discretion is unlawful, threatening, abusive, libellous, defamatory, obscene, vulgar, offensive, pornographic, profane, sexually explicit or indecent, (iii) constitutes or encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate law, (iv) violates, plagiarises or infringes the rights of third parties including, without limitation, copyright, trademark, patent, rights of privacy or publicity or any other proprietary right, (v) contains a computer virus or other harmful component, or (vi) constitutes or contains false or misleading indications of origin or statements of fact. Except for the use of a legitimate e-mail address or post office box of a person or office designated by the Employer for receipt of replies to postings, Employer shall not falsely identify the party on whose behalf a posting has been made.
RIGHT TO CONTROL CONTENT.
WEBJOBZ, has the right, but not the obligation, to monitor the content of postings submitted to the website, in order to determine whether postings are in compliance with these Terms and Conditions and are otherwise appropriate for the website, or for any other lawful purpose. WEBJOBZ, may refuse to post any submission, or may remove from the website any posting, that WEBJOBZ, in its sole discretion finds to be not in compliance with these Terms and Conditions, or otherwise finds to be objectionable or inappropriate.
DURATION AND CANCELLATION OF POSTINGS.
All paid postings will appear in the Webjobz Group site’s database immediately and remain on the site for up to 60 days or the expiry date is reached or the posting is removed by WEBJOBZ or the Employer, whichever is the sooner.
ERRORS; SOLE REMEDY.
Any job listing that is accepted for posting on the website will be posted using the information as submitted by the Employer. Employer bears sole responsibility for the accuracy of submitted information. WEBJOBZ, will not be responsible for any error in a posting unless caused by a technical error or equipment failure on the part of WEBJOBZ, , in which event WEBJOBZ, ‘s sole responsibility and liability shall be to remove the erroneous posting and repost it with the information as originally submitted by Employer.
The Webjobz Group websites are protected by copyright as a collective work and/or compilation, pursuant to Australian copyright laws, international conventions, and other copyright laws. All materials contained on the Webjobz group websites (“Content”) are protected by copyright, and are either owned, controlled or licensed by WEBJOBZ, Employer will abide by any and all additional copyright notices, information, or restrictions contained in any Content. Unless otherwise explicitly stated on the website, Employer may print but may not otherwise download the Content without the express written consent of WEBJOBZ, provided that Employer maintains all copyright and other notices contained in such Content.
CONFIDENTIALITY NOT GUARANTEED.
Employer acknowledges that transmissions to and from the website are not confidential and Employer’s Communications may be read or intercepted by others. Employer acknowledges that by its submitting Communications to WEBJOBZ, no confidential, fiduciary, contractually implied or other relationship is created between Employer and WEBJOBZ, other than pursuant to the Terms and Conditions.
Employer hereby agrees to indemnify, defend and hold WEBJOBZ, and any of its officers, directors, owners, agents, employees, information providers, affiliates, licensors and licensees (collectively, the “Indemnified Parties”) harmless from and against any and all liability and costs, including, without limitation, regulatory penalties, attorneys fees and costs incurred by the Indemnified Parties in connection with any claim arising out of Employer’s use of the website or any breach by Employer of the Terms and Conditions, including, but not limited to, all liability and costs to WEBJOBZ, for Employer’s infringement of any of Employer’s warranties, representations or acknowledgments herein. Employer shall cooperate as fully as reasonably required in the defence of any claim. WEBJOBZ, reserves the right, at its own expense, to assume the exclusive defence and control of any matter other-wise subject to indemnification by Employer and Employer shall not in any event settle any matter related hereto without the written consent of WEBJOBZ.
CHANGES TO CONTENT.
WEBJOBZ, may change, suspend, or discontinue any aspect of the website at any time, including the availability of any website feature, database, or Content.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

(d) Instructions on the website direct job seekers using the website to respond directly to Employer. Any responses mistakenly sent to WEBJOBZ, will not be forwarded or returned. THE POSTINGS ON THE EXPATJOBS NETWORK WEBSITE ARE AVAILABLE TO BE VIEWED BY ALL USERS OF THE INTERNET. WEBJOBZ, DOES NOT INVESTIGATE, INTERVIEW, SCREEN, OR OTHERWISE REVIEW THE IDENTITY, BACKGROUND, QUALIFICATIONS, OR ANY OTHER CHARACTERISTICS OF PERSONS WHO RESPOND TO POSTINGS OF POSITIONS ON THE WEBSITE (“RESPONDENTS”). EMPLOYER AGREES TO ASSUME ALL RISKS INVOLVED IN OR ARISING FROM DEALINGS WITH, AND WITH RESPECT TO, SUCH RESPONDENTS, INCLUDING BUT NOT LIMITED TO EMPLOYMENT-RELATED DECISIONS.
(e) Links and pointers from the website to other sites or resources on the World Wide Web, or from third-party sites to the WEBJOBZ, website, do not constitute an endorsement by WEBJOBZ, or any of its subsidiaries or affiliates of any third-party resources or their contents.
(f) IF APPLICABLE LAW DOES NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, THE LIMITATIONS ABOVE MAY NOT APPLY TO YOU. IN NO EVENT SHALL THE LIABILITY OF WEBJOBZ, AND ITS SUBSIDIARIES AND AFFILIATES FOR ALL DAMAGES, LOSS AND CAUSES OF ACTION, INCLUDING BUT NOT LIMITED TO CONTRACT, TORT, ITS OWN NEGLIGENCE, UNDER STRICT LIABILITY, OR ANY OTHER THEORY, EXCEED THE AMOUNT PAID BY YOU FOR THE TRANSACTION FROM WHICH, OR IN RELATION TO WHICH, THE CLAIM AROSE.
Amendment of Terms and Conditions. WEBJOBZ, reserves the right, at its sole discretion, to change, modify, add or remove any portion of this Agreement, in whole or in part, at any time. Notification of changes in the Agreement will be posted on the WEBJOBZ, website.
JOB SEEKERS TERMS and Conditions
1) By entering their details on our websites, jobseekers confirm that they are a genuine job seeker looking for employment opportunities.
3) By entering a CV/Resume into our database any referees will be automatically contacted by e-mail to complete a confidential on-line reference. Information contained in such references will be freely available to our sites Company Members and Recruiters.
4) When a Job Seeker enters their Cv/Resume and elects to remain anonymous, all contact details and identity will be withheld from Employers/Recruiters.
5) Job Seekers must not enter any of their own or others contact details such as e-mail address, postal address, telephone, fax, cell/mobile/sms/page numbers in any of the following fields: Ideal Next Job, Required Salary & Conditions, Summary, Work Experience, Comments/ Hobbies/ Interests.
